Backup X ("we," "our," or "us") is committed to protecting your privacy. Backup X is open source software that does not collect, store, or transmit any user data to us. This Privacy Policy explains how we handle data in relation to our applications and services.

This Privacy Policy applies to our applications and services. By accessing or using our Service, you signify that you have read, understood, and agree to this Privacy Policy and our Terms of Service.

Data we do not collect

We do not collect your personal data. We do not use analytics SDKs, telemetry, or any third-party services that collect user data. We do not collect names, emails, usage patterns, session data, or any information that identifies you.

Local file system access

Backup X reads the files and folders you choose as backup sources and writes them to the destinations you configure. All of this happens on your own computer and under your direct control. Backup X does not transmit the contents, paths, or sizes of your files to us or to any third party. The application only accesses the items you explicitly add as backup entries.

Backup destinations and object storage

When you configure a destination, Backup X writes your data only to the location you choose. For local destinations, files are copied to the folder you select. For object storage (S3-compatible) destinations, your files are uploaded directly from your computer to the bucket and endpoint you configure. We do not operate, receive, or have access to those destinations — they belong to you and are governed by your own provider's terms and privacy policy.

Credentials and the operating system secret store

Backup X never writes your object storage secret key to its configuration file. Secret credentials are kept in your operating system's secret store and loaded only when a backup runs:

  • macOS: login Keychain
  • Windows: Data Protection API (per-user)
  • Linux: Secret Service (secret-tool)

These credentials remain on your device and are never sent to us. We recommend using a least-privilege key with permission only to write to your target bucket and prefix.

Definitions and key terms

To help explain things as clearly as possible in this Privacy Policy, every time any of these terms are referenced, are strictly defined as:

  • You: a person or entity that uses Backup X applications or services.
  • Application: Backup X's app(s), available on supported desktop platforms (macOS, Windows, Linux).
  • Service: the service provided by Backup X as described in the relative terms (if available) and on this platform.
  • Device: any computer or device that can be used to run Backup X and use the services.
  • Country: where Backup X or the owners/founders of Backup X are based, in this case is Brasil.
  • Company: when this policy mentions "Company," "we," "us," or "our," it refers to Backup X.
  • Local Data: data generated by the app and stored only on your device (e.g. backup entries, provider options, preferences). It is not sent to us.

Sale of Business

In the event of a sale, merger, or other transfer of all or substantially all of the assets of Backup X, or if we discontinue our business or file or have filed against us a petition in bankruptcy, reorganization or similar proceeding, we reserve the right to transfer any information we hold to a third party, provided that the third party agrees to adhere to the terms of this Privacy Policy. As we do not collect personal data, this would not include user personal information.

Affiliates

We do not share your personal data with affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity which directly or indirectly controls, is controlled by or is under common control with Backup X. If we ever did share information with affiliates, it would be in accordance with this Privacy Policy.

Governing Law

This Privacy Policy is governed by the laws of Brasil without regard to its conflict of laws provision. You consent to the exclusive jurisdiction of the courts in connection with any action or dispute arising between the parties under or in connection with this Privacy Policy except for those individuals who may have rights to make claims under Privacy Shield, or the Swiss-US framework.

The laws of Brasil, excluding its conflicts of law rules, shall govern this Agreement and your use of the app. Your use of the app may also be subject to other local, state, national, or international laws.

By using Backup X or contacting us directly, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, you should not use our app or services. Continued use of the app, direct engagement with us, or following the posting of changes to this Privacy Policy that do not significantly affect the use or disclosure of your personal information will mean that you accept those changes.

Your Consent

By using our app or services, you consent to this Privacy Policy. We do not collect personal data and all file operations happen on your device and to the destinations you configure.

Links to Other Websites

This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by Backup X. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Please remember that when you use a link to go from the Services to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our platform, is subject to that website's own rules and policies. Such third parties may use their own cookies or other methods to collect information about you.

Local Data Storage

Backup X stores its configuration only on your device (for example, your backup entries, provider options, and preferences) so the application opens already restored and ready to run. This data is not sent to us. Sensitive secrets are kept out of the configuration file and held in the operating system secret store. You can clear this data through your operating system or by uninstalling the app.

Managing Local Data Storage

You can manage or clear locally stored data through your operating system's settings or by uninstalling the app. Clearing stored data may affect app functionality or cause you to lose saved backup entries and preferences.

Kids' Privacy

We do not collect personal data from anyone, including children under 13. If you believe a child has shared personal data with us through the app, please contact us; we do not maintain user data servers for this purpose.

Changes To Our Privacy Policy

We may update this Privacy Policy from time to time. Unless otherwise required by law, we will notify you (e.g. through our Service or this page) before changes take effect. Continued use of the Service after changes means you accept the updated Privacy Policy. If you do not agree, you should stop using the app.

Third-Party Services

We may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services ("Third-Party Services").

You acknowledge and agree that Backup X shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. Backup X does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.

Information about General Data Protection Regulation (GDPR)

If you are in the European Economic Area (EEA), please note that we do not collect or process your personal data. We do not store user data on any servers. We respect GDPR principles and do not collect personal data that would fall under its scope.

Individual Data Subject's Rights

Because we do not collect or store your personal data, there is no data held by us to access, port, or delete.

California Residents

Under the California Consumer Privacy Act (CCPA), we disclose: we do not collect personal information from you. We do not sell personal information. We do not share your personal information with third parties for cross-context behavioral advertising.
